Please read these Terms and Conditions carefully before engaging the services of Poems and Power Publishing (“we,” “us,” or “our”). By signing a service agreement or making a payment, you (“the Client”) agree to be bound by these terms.

1. Services

Poems and Power Publishing provides self-publishing services including but not limited to manuscript consultation, editing, book design and layout, cover design, publishing platform setup, and marketing support.

2. Payment

  • A payment in full for your chosen service package is required to reserve your project start date and begin work.
  • All prices are in US Dollars unless otherwise specified.

3. Refunds and Cancellations

  • All payments made are non-refundable once work has commenced.
  • A prorated refund for uncompleted work may be issued at our sole discretion.
  • Poems and Power Publishing reserves the right to cancel a project at any time if the working relationship becomes untenable.

4. Client Responsibilities

The Client agrees to:

  • Provide all necessary materials, manuscript content, and feedback in a timely manner.
  • Respond to requests for approvals or revisions within 14 business days. Delays caused by the Client may affect project timelines.
  • Represent that all content submitted is original, owned by the Client, or properly licensed for use.
  • Maintain their own accounts on publishing platforms (Amazon KDP, IngramSpark, etc.) as required.

5. Intellectual Property and Rights

  • The Client retains 100% ownership of their manuscript, story, and all written content at all times.
  • Upon completion of work, the Client owns all deliverables produced by Poems and Power Publishing for their project, including interior layout files and cover design files.
  • Poems and Power Publishing retains the right to display completed work in our portfolio, on our website, and in marketing materials unless the Client requests otherwise in writing.
  • We are a self-publishing service — we do not acquire publishing rights, distribution rights, or any share of royalties. All royalties belong entirely to the Client.

6. Timelines

Project timelines are estimated and provided in good faith. Poems and Power Publishing will make every reasonable effort to meet agreed-upon deadlines. However, timelines may be affected by Client delays in providing materials or approvals, scope changes, or circumstances beyond our control. We are not liable for delays caused by third-party publishing platforms.

7. Confidentiality

Poems and Power Publishing treats all Client manuscripts, personal information, and project details as confidential. We will not share your unpublished work with third parties without your written consent, except as required to perform the contracted services (e.g., with our design or editing team members).

8. Limitation of Liability

Poems and Power Publishing is not liable for any indirect, incidental, or consequential damages arising from the use of our services, including but not limited to lost profits, lost royalties, or dissatisfaction with publishing platform decisions. Our total liability to the Client shall not exceed the total amount paid by the Client for the specific services in question.

9. Third-Party Platforms

We assist Clients in uploading and distributing their books through third-party platforms such as Amazon KDP and IngramSpark. We have no control over these platforms’ policies, royalty structures, pricing, or decisions regarding content. The Client is responsible for reading and agreeing to the terms of any third-party platform used.

10. Warranty of Originality

The Client warrants that all content submitted is their original work or that they hold appropriate rights to use it, and that it does not infringe upon the intellectual property rights or personal rights of any third party. The Client agrees to indemnify and hold Poems and Power Publishing harmless from any claims arising from submitted content.

11. Governing Law

These Terms and Conditions are governed by the laws of the State of Kansas, without regard to its conflict of law provisions. Any disputes arising from these terms shall be resolved in the courts of the State of Kansas.

12. Changes to These Terms

Poems and Power Publishing reserves the right to update these Terms and Conditions at any time. Changes will be posted on our website with an updated effective date. Continued use of our services after changes constitutes acceptance of the revised terms.
